Rules for conducting exchange transactions


1. General Provisions

1.1. This Agreement establishes the features of the provision of Exchange services by the Online Service.

1.2. An online service refers to an online resource for exchanging virtual money -

1.3. Users are considered individuals and organizations (s) who have expressed their consent to cooperate with the Online Service.

1.4. By common mention, the User and the Online resource are called Parties.

1.5. The parties agree that this electronic Agreement is equally valid with a written contract and is designed to regulate their relations in the process of consuming exchange services.

1.6. The Agreement is considered a public offer, the acceptance of which occurs by filling out an application by the User to receive the services provided by the Online Service. The application is submitted through the web resource.

2. Subject of the Agreement

2.1. The online resource provides services, the list of which is specified in clause 4 of the Agreement, but the User is obliged to follow the standards set forth in clause 9. "Procedure for performing exchange operations". Services are provided in the manner specified by the Regulations, the provisions of which are specified in paragraph 5 of the Agreement. 

2.2. The user who completed the exchange operation must pay for it.

3. Mutual obligations of the Parties

3.1. The online service assumes the following obligations:

3.1.1. Ensure the conversion of electronic money of such payment services as Yandex.Money , Payeer, Qiwi, OKPAY, and adhere to the standards established by this Agreement.

3.1.2. Provide informational and technical support to Users as they consume services provided by the Online Service.

3.1.3. To guarantee the confidentiality of information regarding the execution of exchange operations (personal information of customers, transaction time, amount) and transmit it to Users who have made the relevant payments. If an anonymous payment system took part in the exchange process , then such an operation receives the status of “confidential” and is not subject to further disclosure.

3.1.4. Restrict unauthorized access to payment details.

3.1.5. Provide the user with discounts in the manner prescribed by the Agreement.

3.1.6. Ensure the transfer of funds to the account of the User or a third party no later than one day after the receipt of the complaint in the situations listed in clauses 3.2.5, 5.4-5.6 of the Agreement.

3.1.7. Keep secret and not disclose information on exchange transactions, as well as personal data of the Internet Service User to third parties, with the exception of the following situations: - by legal decision of the court at the location of the owner of the Internet service; - at the legitimate request of the competent authorities at the location of the owner of the Internet service; - at the request of the administration of one of the payment systems, namely Perfect Money, OKPAY, Payeer, Qiwi, Yandex. Money and others.

3.2. The user assumes the following obligations:

3.2.1. Transfer the most accurate information to the Online Service to ensure prompt exchange.

3.2. 2. Designate the true details of your email address.

3.2.3. Create opportunities for receiving notifications from the system by e-mail. Provide access to the network using a computer or other device. Install anti-virus programs so that the connection to the Online resource is as secure as possible.

3.2.4. Comply with the requirements of this Agreement.

3.2.5. Notify the administration of the resource if the funds have not been fully or partially credited to the recipient"s account. And also about all situations when there were circumstances specified in paragraphs 5.4-5.6 of this Agreement. The notification should be sent to the administration no later than a month after the occurrence of the corresponding incident. Failure to do so will result in the transfer of disputed amounts to the account of the Online Service.

3.2.6. Comply with the laws of your country of residence and citizenship.

3.2.7. Do not violate the requirements of regulations establishing the features of online exchange.

3.3. Rights of the online service

3.3.1. To temporarily stop the service for troubleshooting and upgrading.

3.3.2. Stop the transaction if an appeal from the competent authorities, partners or a complaint from the User about fraudulent actions has been received. The exchange stops for the time necessary to clarify the situation.

3.3.3. At its discretion, establish a system of discounts on exchange transactions. The exchange discount is not taken into account if the exchange service does not receive profit on the application, i.e. the percentage of exchange is negative or equal to 0.

3.3.4. Set and change exchange fees.

3.3.5. Limit the potential User in access to their services without explaining the reasons for refusal.

3.3.6. If an error is made in the exchange process, the Online Service has the right to require the User to confirm the completed operation using communication tools, e-mail, a screenshot of a virtual purse.

3.3.7. To interrupt a conversation with a User who is inadequately conducting or restricting employees in obtaining the data necessary to solve his problem.

3.3.8. Block the payment in the cases provided for in cl 5.4-5.6 of this Agreement or the Rules.

3.3.9. Block the transfer, and do not return the money until the User is identified.

3.4. The security service of the service has the right to freeze the client’s application in case if he received illegal enrichment in this or a third-party exchange service in any way and is on the list of debtors, until the reasons are clarified and the damages incurred by the exchangers from this user are clarified . 

3.5. The exchange service reserves the right to revise the terms of compensation in the referral program. 

3.6. Referral fees are not accrued if the exchange service makes a profit of less than 0.6%.

3.7. Referral charges can be withdrawn if the invitation has 5 or more referrals. Also, each of the 5 referrals must have at least one successful application. 

3.8. The online service has the right to suspend the operation in case of identifying the purpose of the client making profit on the difference in exchange service rates. In this case, the application is blocked until the circumstances of the administration of the service.  

3.9. The service has the right to recalculate the rate fixed on the application in the event of:
- a long delay in the receipt of funds from the client to the service, due to a delay on the part of a third-party service.
- the client indicated the minimum commission for the transfer per transaction, which led to a long delay in the receipt of funds to the account of the service.

4. Services.

4.1. conducts electronic money exchange operations of payment systems such as Bitcoin, Perfect Money, OKPAY, Yandex Money, Payeer, QiwiBanks are involved in making payments, a list of which is available on the site;

4.2. The online service does not have the authority to check the availability of the User’s rights to the funds that are involved in the exchange.

5. Rules of exchange transactions.

5.1. The exchange starts upon the transfer of money from the User.

5.2. The exchange is considered completed after the transfer of money to the details provided by the Client.

5.3. The user does not have the right to cancel the operation after it has begun or to demand the return of funds transferred for the exchange.

5.4. If the User transferred the amount, the amount of which does not match the details specified when making the exchange, then the Online Service has the right to stop the operation or carry out the operation taking into account the amount received by the Online Service. Also, upon the fact of the User’s request in accordance with clause 3.2.5, the Online Service exchanges the actually transferred amount, taking into account the exchange rate that is current at the time of the start of the transaction.

5.5. If an incorrect account is specified, the exchange is not performed. The money is returned to the User upon his application on the basis of clause 3.2.5. At the same time, commissions are charged, as well as a fine of 2% of the transfer amount.

5.6. If the User has adjusted the payment amount or made a payment from someone else"s account, the Online Service has the right to block such payment. The refund occurs at the request of the User on the basis of clause 3.2.5. But the User is charged a commission and a fine of 1%.

5.7. If the user of the exchanger makes an exchange in the direction of the Bitcoin cryptocurrency, i.e. changes any of those presented in the service to Bitcoin, it should be borne in mind that transactions in the Bitcoin network take from 15 minutes to several days. This is in no way dependent on the exchanger and it cannot influence the situation or speed up the processing of the transaction.

5.8 Receipts of funds in the direction of Visa/Master Card can take up to 5 (five) banking days.

5.9 The client undertakes to pay for the application within 15 minutes, otherwise the application may be deleted or recalculated at the current rate.

6. Responsibility of the Parties and Warranties of the Online Service

6. 1. Resource - exchange Bucksman does not bear any legal responsibility for the consequences of improper use of the service or for errors made by the User during filling out the application for the exchange of virtual currency. Payment is not canceled even if the money was sent to the wrong account. 

6.2. The online service does not pay for the damage resulting from the loss of operability of the equipment as a whole or its individual parts that are used by the User during the exchange.

6.3. The online service is not responsible for delays in payment or inaccuracies made in its process arising from the actions of banks or payment systems. The exchanger is not responsible for subsequent blocking of bank cards and accounts of payment systems of the user after the exchange operation.

6.4. is not responsible for the costs and losses of the User arising as a result of erroneous representations of the latter regarding tariffs, profitability of exchange or other subjective moments.

6.5. The online service does not compensate for the costs caused by delays or errors in the exchange process.

6.6. The user confirms the existence of legal grounds for the disposal of funds participating in the exchange.

6.7. All losses of third parties resulting from the use of the resources of the Online Service by the User are fully compensated by the latter, due to the return and deduction from future applications.

7. The procedure for changing working conditions

7. 1. The administration of is entitled at any time to amend or supplement this Agreement. They gain strength and begin to act after they are published on the resource.

8. Unseen circumstances

8.1. In the event of insuperable circumstances, the Parties are exempted from liability for failure to fulfill or untimely fulfillment of the terms of this Agreement. Insurmountable circumstances are understood as war, terrorist attack, fire, flood, riots, hacking, acts of local authorities. They also include a power outage and lack of access to networks, including the Internet and communication services.

9. The order of the exchange operations

9.1. The online service cannot be used for illegal operations. The user agrees to be held liable for an attempt to exchange doubtful funds, in accordance with the norms of the state within which the violation was committed.

9.2. If the illegality of the payment is proved, the Online Service has the right to provide information about this at the request of law enforcement agencies, the payment system or the injured party.

9.3. To make an exchange, the User must withdraw from his virtual purse the appropriate number of electronic banknotes. At the same time, he is personally responsible for the existence of legal grounds for crediting money to the wallet, since the verification of the legality of this operation is not the responsibility of the Online Service.

9.4. A bank transfer is possible as part of an online banking payment system. If the application was processed through a banking operator or ATM, then the money is returned to the User no later than 24 hours. When transferring to a Sberbank card, the User must pay 1% of the payment amount. The return of funds occurs solely upon the determination by the security service of the sender of the transfer. 

9.5. The online service is not responsible for payments made by consent of the User by third parties.

9.6. The user accepts the Agreement in full by activating the "I agree with the rules of exchange" button.
